Criminology 1/25/07 Homicide- Killing of a person by another person (Not a Crime) Suicide is not a crime Attempted suicide not a crime Criminal Homicide consists of either murder (the crime) In California the unlawful killing of a human being or fetus with malice of forethought Three Factors- Malice of Forethought 1. Motive 2. Planning 3. Nature of Killing Do not need to know if woman is pregnant or not to be convicted Two categories of murder 1. First Degree- Premeditation, Deliberation (Planning), Intent to kill, Malice a. Go to kill someone and accidentally shoot the person behind. First Degree because of transfer of intent b. Drive by shooting shoot innocent girl inside First Degree 2. Second Degree- anything you cannot convict of first degree murder for Punishment for first degree murder in California-25 to life w/o parole maybe death penalty Manslaughter- Unlawful killing of a human being without malice “heat of passion” Unlawful killing is murder Need to be an objective and subjective Heat of passion does not need to be suddenly If mutual combat considered manslaughter Imperfect self defense- honest but incorrect release Simple trespass without mortar is murder Involuntary Manslaughter- Vehicular Manslaughter- also includes operation of a vessel Chapter Four- Crime Reporting 1. UCR –statistics kept by law enforcement agencies 2. National Survey- done by census
