To override a Charter right on which the fundamental functionality of our democracy relies would require the salutary effects of a legislation to be of such importance that would justify the possibility of brining the administration of our democratic political system into disrepute. To the extent that the legislation, in the words of His Honour Lefsrud, prevents babies from voting, the salutary effects of the legislation outweigh its deleterious effects. However, the legislation as it currently stands bars anyone under the age of 18 from voting who otherwise would have met the requirements pursuant to the Canada Elections Act....
