Difference between Torrens System v English Title Deed System Under common law, English Title Deed System, the land owners need to prove ownership of a piece of land back to the earliest grant of land by the Crown to its first owner ,it may be hundreds of years ago. The grant it the prove for the ownership. The d ocuments therefore are known as title deeds of chain of title Under this system, a person‟s ownership of land could also be challenged, potentially causing great legal costto land owners. Even if chain of title is found, it would not give complete security due to principle of nemo dat quod non habed and also possibility of outstanding interests undetected. The effect of registration under title deeds system was to only give registered „priority‟ over all other instruments that are registered/unregistered –thus not as strong as indefeasibility. Under Torrens System, the purposes of this system is to have a system of registration of titles of land that is fast, reliable and smooth in operation. The main characteristics of Torrens System is first that, it is an indefeasible title upon registration and can be only defeated when there is fraud/mistake. Thus the title, will be unlawfully acquired. It also deals on alienated land and must registeredthe relevant land The basic difference between this system and Torrens System is that, English Title Deed is known as the register of the instrumens and for Torren System it it known as the register of title.
