April 25, 2013 Guantanamo Blaming and shaming report – “a decade of…” Human rights strategy Compliance Not enough domestic pressure Usually a state infringing human rights of its own citizens In guatanamo there is not interest from civil society to invoke and struggle  for human rights Also the violator is the most powerful state and a democracy – incentivize  the USA is difficult Other incentives were foreign aid, trade agreements  Human rights regulations do not apply outside the US Extraterritorial excuse doesn’t work because human rights responsibility  applies wherever you are excercising power Torture in war is also prohibited No fair trial, death penalty would be considered extrajudicial execution,  taking them in the first place,  Rights protect because of convention against torture War vs crime Prisoner of war Detainees International humanitarian law violations
