Copyright Act of 1976 – became effective January 1, 1978. 1909 Act: Two Types of Copyright - Common Law: protected nonpublished works according to state law - Statutory: protected published works according to 1909 Act A copyright work is still subject to defamation/privacy/breach of contract law Marx Brothers case – took their persona. Looks like copyright because it’s an artistic work product. Yet states have taken the position that right of publicity is similar to copyright law,  it’s not identical. Internet has a problem because there are certain rules that apply to internet  providers/websites. One set of rules for Intellectual Property and one for everything  else. Where is Right of Publicity? Under 1909 Act, copyright protection was granted to all the writings of an author.  Photographs, motion pictures, sound recordings, etc. However, inconsistent in extending these. You cant “read” a motion picture.

That’s why a change was created in 1976. -Original works of authorship fixed in any tangible medium of expression  (recorded in some way: writing, digitally, photographically) now known or later  developed from which they can be perceived, reproduced, or otherwise communicated  either directly or with a machine or device.
