J Lawrence From: Alex Kissinger Re: Kathy’s Party Date: February 10, 2013 During the time that Kathy’s parents were celebrating their 25 th anniversary at a New Jersey beach, Kathy threw a party. The parents had no knowledge of the party until Kathy’s father called home and heard music and yelling. The father told Kathy to behave and not get into trouble. Kathy’s father Joe has a large bar in the house that became the main attraction. At 3 am Kathy called her parents crying because her friend, Brian Sullivan was involved in an accident a block away from the house. He was intoxicated and seriously injured in the accident. His parents are now filing a lawsuit against the Roberts family. In a similar case, appellant Unterberger was served alcohol at a university and later caused a fire resulting in $400,000. The University was not involved in the planning, serving, or purchasing of liquor just as Kathy’s parents were not involved in the planning or serving of liquor in the house. According to the previous case, the Roberts should not be liable for Brian Sullivan. They were not present and had no knowledge of the party until Mr. Roberts called home. Kathy also should not be liable for Mr. Sullivan because she was also a minor. A minor is not liable for another minors injuries that may have been sustained as a result of the host minor’s distribution of alcohol to someone under 21. As for the alcohol in the house, the parents were not personally serving it. Guests were taking it at their own convenience without the parents or Kathys consent....
