Tocqueville What is political freedom in his view? ~Democracy ~In the US, Religion shapes democracy: Religion shapes mores and  therefore laws, and religion contributes to the sense of freedom b/c  it promotes good behavior in society; religion indirectly shapes  freedom Major Problem: -Majority Tyranny- When will of the majority oppresses the minority; there  is only majority tyranny when there are no  restraints  (p.242) Solutions: -Restraints: Legislative body not slave to passions of the majority           Executive power with a force of its own           Independent Judiciary (from Executive and Legislature) -Mores protect the US from falling into tyranny of majority Publius (Madison and Hamilton) The problem of freedom is factions. Definition of faction: a majority or minority  united by some common impulse or interest that is adverse to the rights of
