The Issue of Judicial Review Define democracy Direct Indirect or Representative Majority Rule A substantive definition of democracy: Federalist Paper #10, “Madisonian” and Participatory Democracy “Direct Democracy” -A form of government in which citizens make governmental decisions. THE IDEAL OF THE NEW ENGLAND TOWN HALL MEETING -Clearly, we do not have a direct democracy -But, there are means of direct citizen participation in the US -State referendums -Juries -Citizen Suits “Representative” or “Indirect” Democracy -A form of government in which citizens elect governmental officials, who make and enforce the laws (rule by consent) -Do we have a representative democracy? -We have elected officials, but they serve in a constitutional democracy, which features judicial review, a written bill of rights, means of direct democracy, and a whole host of non majoritarian mechanisms (including the Electoral College, presidential veto, apportionment, etc.) -In short, we have a MIXED government that blends diversely representative institutions and policy-making forums.
