04:56 23. 1 // Robinson v. Durham Facts : Plaintiff, the Robinsons first purchased a Chevrolet Camaro as a female transferred the tag receipts to attain title. Later, defendant Durham purchased an automobile from appellants. Soon after, the FBI seized the car, since it was reported stolen in Florida and eventually returned. Durham filed a suit, alleging fraud, breach of contract, and breach of warranty. He did not know the truth and was awarded $5,200. The plaintiff thinks that the title should have been transferred to Durham. Issue : Did Durham attain title to the car? Holding : No, Durham never obtained title, since the title was void. Rule of Law : When a person has stolen goods, he cannot pass title to another. A thief gets void title. Since the car was stolen, the appellants could not convey title to Durham, as the title was void. 23.2 // Heinrich v. Titus-Will Sales Inc. Facts : Plaintiff Michael Heinrich wanted to buy a Ford pickup truck. Dealer, James Wilson helped him with this process, although he was unaware that he had lost his Washington vehicle dealer license. Heinrich made two payments. Eventually, the dealer
