Week 5 Religion Establishment cause- Congress shall not establish religion Engle vs Vitale (1962) o Took prayer out of the schools Decisions can be summarized as Patchwork o Make it up as they go along Allow this but not that. Lemon vs. Kurtzman o Sets guidelines to determine if the law abides by the establishment clause o Fisrt question about law – Does the law have a secular purpose? – answer has to be yes for the law to be constitutional o 2 nd Question – Does the law advance or prohibits religion? Answer has to be NO It does advance it o 3 rd Part – does it require the government to get too entangled or caught up in religion? Free Exercise of religion o The state cannot inhibit the way you worship o Reynolds vs. United States Distinction between belief and practice. Believe what ever you want, but you cannot practice what ever you want. o
