Abby Alon HW #16 1. Judicial review is a main component of our checks and balances system. Today few people would deny to the courts the right to decide that a legislative or executive act is unconstitutional, although at some point in time this idea was not accepted universally. 2. The strict constructionist approach is when we think that judges must interpret the constitution word for word. The second approach is called the activist approach in which judges should discover and understand the general principles in the Constitution (usually with the vague language the constitution so often has) and increase those principles on the basis of some moral or economic philosophy and apply them. 3. John Marshall said that national law was the dominant law, with state law allowing this to happen, and that the Supreme Court had the power to decipher the words of the constitution. Marshall declared that the Supreme Court could declare an act of congress unconstitutional. The federal law is Supreme Court
