2 INTERCEPTION OF COMMUNICATION Interception of Wire, Electronic or Oral Communication Interception of wire, electronic or oral communication is a prohibited act in the US. The US statutes give a provision for exceptions in case the federal court has given an order for the interception. The use of trap and trace devices or pen register is also unlawful. This section of the statute also provides exceptions where the service provider of an electronic device or the wire communication. Section 2511(2)(a)I state that it is legal for an officer, agent or a switchboard operator of a communication provider to intercept, give out information or use the service while performing his/her duties as per the employment policies.
