8.2 Written Assignment 1. How can Cockrell v. Pearl River Valley Water Supply Dist. and Lyon v. Carey be reconciled? Both cases involve assault by an agent, but in the lyon case the agent’s actions were imputed to the principal and in cockrell the agents actions were not imputed to the principal. In Lyon vs carey, the actions were imputed due to the agent acting on behalf of the principals request to obtain payment and this then turned into an argument which led to the agent raping the customer. The case is reconciled by holding the principal liable for the assault. “An agent may create legal liability for the principal for actions taken by the agent within the scope of the agency”.
