12th grader, Alfonzo Lopez, at San Antonio Texas High School, carried a concealed
weapon into his High School, he was charged under the Texas law with firearm possession on
Federal agents got involved and dropped charges against Lopez on the state level
and instead charged him with violating a federal criminal
Lopez was charged on a state level. The question was posed upon the courts
questioning if the 1990 Gun-Free School Zones Act, forbidding individuals from knowingly
carrying a gun in a school zone, unconstitutional because it exceeds the power to Congress to
legislate under the Constitution to legislate under the Commerce Clause?
