Free Speech: Eminem is Entitled to Some Too! Historically, the Free Speech Clause in the First Amendment—“Congress shall make no law . . . abridging the freedom of speech,” has been interpreted to protect individuals from allowing the government to suppress ideas in entertainment. With the support of the First Amendment, courts have consistently ruled that music is among the forms of entertainment which should enjoy free speech guarantees. This protection, unfortunately, is not absolute. One of the difficulties faced by the courts over protection of speech in music involves hateful lyrics in rapper Eminem’s music and the dangers his music poses as opposed to his right to free speech in him lyrics. Eminem, an extremely controversial rapper, has lyrics that support hate and discrimination, causing him to be in the lime-light and be attacked by various groups who try to censor his lyrics. GLAAD (the Gay & Lesbian Alliance against Defamation) publicly protests against Eminem’s music, and upon his Marshall Mathers LP being nominated for a Grammy, GLAAD began to work towards preventing the legendary rapper from winning the Grammy. As an organization, GLAAD lends itself to eliminating homophobia and discrimination by “ensuring fair, accurate and inclusive representation” of people of various sexual orientations.
