The Codex Alimentarius Commission3The Codex Alimentarius Commissionand its Influence on European andNational Food PolicyDario Bevilacqua*Starting from the analysis of EC-Hormones and EC-Biotech cases in front of theDispute Settlement Body of the World Trade Organization, the article will considerthe Codex Alimentarius Commission (CAC), its legal nature and organisation, theway it issues international food standards and their impact on European food poli-cy. The analysis will stress the legal force of CAC standards in its member statesthrough the application of WTO law and it will underline the most critical aspectsof Codex decision-making, above all due to the lack of application of constitutionaland administrative principles (used in national countries to limit the powers ofI.The Codex AlimentariusCommission: some critical issuesin two paradigmatic casesAt its 21stSession, in July 1995, the CodexAlimentarius Commission (CAC) approved a stan-dard concerning the maximum levels of residuesfor five growth-promoting hormones and for bovineSomatropine in meat. The decision was madeafter a secret majority vote and the standard wasapproved with 33 delegates in favour, 29 opposingand 7 abstaining.1The European Communitiesopposed that standard but lost their battle. At the DSBmeeting on 1 December 2003, the EC stated that: in light of thedisagreement between the parties to the dispute with regard tothe EC’s compliance with the DSB’s recommendations, thematter should be referred to the WTO for a multilateraldecision.
