CHAPTER 20 – Products Liability Products Liability – Liability by merchant to purchaser of goods ( tangible and intangible) 1. Buyer had goods, but a breach of warranty took place 2. Buyer never received goods, seller never delivered Injuries caused by Breach of Warranty 1. General Measure- suffered by any/all plaintiffs Remedy: repair or replace 2. Commercial Consequential Damages- breach triggers chain of events leading to economic loss (not necessarily suffered by plaintiffs) 3. Consequential Damages- personal injury/ property damages. Asserted as breach of warranty Privity- Helps identify who plaintiffs are. Relationship that exists between two parties 1. Buyer of goods later in the chain of distribution from seller Functional levels of product distribution: Manufacturer, wholesaler, retailers, customers. Customers have vertical non-privity in relationship to everyone above retailers. 2.
