In this Chapter, we are talking about the performance that is required of parties to
a contract, and the remedies that are available to the non-breaching party when
the other party fails to perform as required. Before talking about performance,
though, we have to first find out if there is, in fact, a duty to perform at all . This is
where the idea of conditions comes in.
1. What is a condition ?
2. As affecting the duty to perform, there are 3 types of conditions ; what are
