LEGISLATIVE DEPARTMENT A: It is the party‐list representatives who are elected into office, not their parties or organizations. These representatives are elected, however, through that peculiar party‐list system that the Constitution authorized and that Congress by law established where the voters cast their votes for the organizations or parties to which such party‐list representatives belong. (Abayon v. HRET, G.R. No. 189466, Feb. 11, 2010) Q: What are the qualifications of party‐list nominees? A: 1. Natural‐ born citizen of the Philippines 2. Registered voter 3. Resident of the Philippines for at least 1 year immediately preceding the day of the election 4. Able to read and write 5. Bona fide member of the party or organization which he seeks to represent at least 90 days preceding election day 6. At least 25 years of age. (not more than 30 years old for nominees for youth sector) Note: There is absolutely nothing in R.A. 7941 that prohibits COMELEC from disclosing or even publishing through mediums other than the “Certified List” the names of the party‐list nominees. As may be noted, no national security or like concerns is involved in the disclosure of the names of the party‐list groups in question (Bantay RA 7941 v. COMELEC, G.R. No. 177271; G.R.
