MARTINEZ 205 UST GOLDEN NOTES 2011 In case of tie between and among the highest ranking Sangguniang members, resolved by drawing lots (Section 44, LGC). The general rule is that the successor (by appointment) should come from the same political party as the Sangunian member whose position has become vacant. The exception would be in the case of vacancy in the Sangguniang barangay. 2. In case automatic succession is not applicable and there is vacancy in the membership of the sanggunian: a. b. c. The President thru the Executive Secretary shall appoint the political nominee of the local executive for the sangguniang panlalawigan/panlungsod of highly urbanized cities/independent component cities The Governor, shall appoint the political nominees for the sanggunian panlungsod of component cities/bayan concerned The city/municipal mayor shall appoint the recommendee of the sangguniang barangay concerned. Note: The “last vacancy” in the Sanggunian refers to that created by the elevation of the member formerly occupying the next higher in rank which in turn also had become vacant by any of the causes already enumerated. The term “last vacancy” is thus used in Section 45(b) to differentiate it from the other vacancy previously created.
