At the time of publication, Hemingway secured protection under federal copyright law for the title and content of the novel. When Hemingway died in 1961 (in a suicide involving a shotgun), his rights to The Old Man and the Sea passed to his estate (the “Estate”). In 2010, author Jessica Jest (“Jest”) published a novel titled The Old Man and the Ocean. Jest did not publish the novel under her own name but rather under the literary pseudonym “Elvis Hemway.” Jest’s The Old Man and the Ocean was a comic spoof based on the same characters and plot in Hemingway’s The Old Man and the Sea.
