Morgan Abrams Professor Giluk Current Event 9/14/11 “‘Big Guy Sues White Castle over Small Booths” Typically, fast food chains get sued by customers relating to the food or sickness caused by the food. But in Martin Kessman’s case, he is suing White Castle because of its seating. Kessman, at the age of 64, is a 209-pound stockbroker from New York. His disagreement with White Castle began when Kessman was trying to wedge himself into a booth and he hit his leg on a metal pole under the table. Kessman filed a complaint with the local manager and after no response he filed a complaint with corporate and was then sent condescending letters and 3 coupons. After the fast food restaurant failed to respond to his complaint, Kessman filed a lawsuit against White Castle, claiming that they are violating the American’s With Diabetes Act by not accommodating a customer of his size. Kessman claims that he just, “wants to sit down like a normal person.” Even through all this conflict and embarrassment, Kessman still eats White Castle on a regular basis.
