to affirm Dillon’s claim for promissory estoppel but did not remand Dillon’s breach of contract claim. The implied contract in this case is an “at will agreement” as it “imposes no substantive limitation on the right of contracting parties to modify terms of their arrangement or to specify other terms that supersede the terminable-at-will arrangement”. (Walsh, P633) The employer breached this implied contract when they made the terms of the contract unclear and sent mixed messages regarding the employee’s status. The contract also states that all actions will be carried out in a “fair and consistent manner”. (Walsh, P633) The company also breached the implied contract by not adhering to progressive steps to be taken for certain types of cases, including, “unsatisfactory quality of work, and time periods governing things such as how long a reprimand is considered active”. (Walsh, P633) The disclaimer in the employee manual did not have the desired effect of the employer because the contract that the employer used seemed to support that the “policy and procedures contained in the manual constitute guidelines only.
