CJ309 Short Answer “Evaluation” 1. John makes a threatening and harassing telephone call from his home in Wisconsin to Lucy who receives the call at her home in Texas, a violation of the criminal statutes of both states? Where would jurisdiction lie in this case? What difficulties might be encountered in attempting a prosecution in either state? Harassing phone calls are very frustrating for the people receiving them and understanding if there is anything that the police can do to help or even stop it is the biggest concern for most. Lucy received what she felt was a threatening phone call from John who was noted to be in a completely different state than her. Harassing people and threating them in a phone call is illegal in most states, including Wisconsin where Lucy resides and Texas where John resides. Because this type of behavior is against the law in both states, I believe based on the reading that it would be in the area of criminal jurisdiction that affects communication. The authorities would have jurisdiction in this case, even though the call was placed from one state to the other because it was a threat that made it across state lines via telephone wires (also state property).
