Employment Law “Employment at will” The EEOC is the commission that administers Title VII, Equal Pay Act, Age Discrimination and Employment Act, and the Americans with Disabilities Act. The EEOC can file suit in Federal Court on behalf of individuals who claim their rights have been violated. Remedies can include back pay, reinstatement, and even damages for infliction of emotional distress. Title VII of the Civil Rights Act of 1964 - seeks to eliminate employer and union practices that discriminate against employees on the basis of race, color, religion, sex, or national origin. City of Hartford firefighter case – Ricci v. DeStefano – Read the Syllabus (pages 1-4) Title VII applies to employers with 15 or more employees. There are 2 theories of discrimination. Disparate treatment exists where an employer treats some individuals less favorably than others because of race, color, religion, sex, or national origin . Motive is an essential element.
