DUE PROCESS The main concept behind the idea of due process is that the law is applied equally to all regardless of differences. This idea is intended to be directed especially towards persons who have been accused of committing a crime. The 4 th , 5 th , 6 th and 8 th Amendments are the parts of the Constitution that are most commonly cited in regard to due process. In general, these amendments are set up to ensure that people accused of a crime are not denied their civil rights of freedom, property, legal counsel or life unjustly. These also protect the individual from cruel or unusual punishments. This concept was a basis for establishing procedures for how an investigation is handled, arresting a suspect, setting bail, sentencing and all the steps in between. LEGAL DEFENSES There are three legal defenses. They are self-defense, not guilty by reason of insanity and provocation. If a defendant chooses to use self-defense, they must be able to prove
