Police Officers Jones and Smith suspect that Delbert Defendant has stolen a very expensive sports car from a dealership in San Francisco. They go to Defendant’s home in Daly City. Defendant is not at home and there is a high wooden fence surrounding his property over which they cannot see. The police knock on the next door neighbor’s door who is also not at home. They walk around to the side of Neighbor’s home and go through a gate into the Neighbor’s back yard. By using a stepladder which they find next to the fence, they are able to see over Defendant’s fence into Defendant’s yard. There they see the stolen sports car in Defendant’s back yard. Officers Jones and Smith return to their patrol car and engage in surveillance of Defendant’s home. About half an hour later Defendant’s wife pulls up and, as she is about to
