Remedies: Damages: Compensatory damages (note that David slammed into the Prius, evidence of negligence). Paula p_ersonal injury — medical costs. pain and suffering. lost income. Per diem theory of costs of pain and suffering 0K. Effect of collgteral source rule. Such payments do not reduce D's liability when payment is from insurance. employment benefits. and social legislation benefits. but subrogation is relevant and some jx treat benefits as wage replacement. which would be deducted from recovery or interfere with P's eligibility for benefits. Also. some insurance policies contain a coordination of benefits clause allowing for a reduction in insurance payments if the P receives government benefits. Pete - emotional distress. Peter and Paula — property damage - destruction of Prius with FMV of 312.000 at time of accident. Effect of insurance - same as above. if battery. punitive damages. Restitution: see below. enforcing the judgment. ~ Coercive relief does not seem to apply. Defenses: David will argue that the City is the primary if not exclusive tortfeasor and his liability. if any. is minimal. If he must pay. he can sue the City for indemnification. Enforcing the judgment: David is insolvent. so it will be necessary to lien his house in Marin (an equitable means of restitution). Civil contempt would also be possible if he fails to comply with a court order to sell the house. 2. Paula v. City Hospital - First liability theory: conversion, fraud (see below for latter) Remedies: Damages: Compensatory damages - direct and indirect — for loss of value of tissue sample might be available ($50K FMV at least). If damaged spleen has no value. may avVard nominal damages to springboard punitives for intentional misconduct — although City Hospital. if public. may be immune from punitives. If Hosp. is corporation. Grimshaw guideposts. Also dignitary or emotional distress damages. Bestitution: detinue or replevin of tissue; disgorgement of unjust enrichment of City Hospital via quasi- contract (aka waiving the tort and suing in assumpsit) - if such an agreement is I_eg_a_l. Terms & scope of the quasi-contract can vary. Hospital conduct is willful so can reach to all profits and future proceeds. but an accounting may be required in light of contributions by Hospital staff. Injunction: Permanent injunction to prohibit Hospital from engaging in this practice in the future and/or preliminary injunction to stop sales and research using Paula's tissue. Possible TRO. Defenses: Consent form = waiver? Estoppel? Delayed discovem may skirt possible SOL problem if Hospital has already made millions. Finally. quasi-K for sale of organs (rather than donation) illgal? City Hosp. - Second liability theory: breach of contract or fraudulent misrepresentation Remedies: Consent to removal of organ. not sale. The Hospital failed to disclose that it would be using the spleen tissue for profit. This was not a term of the contract, so breech is not likely. But if the Hospital's silence is actionable in tort as misrepresentation. P would be entitled to remedies as described above. 3. Paula and Peter v. Golden Gate City -- Liability theory: (gross?) negligence Remedies: Damages: Compensatory damages per analysis in Question 1. Possible gross negligence giving rise to punitive damages since City knew about the defective stoplight and refused to fix it. Coercive reliefi injunction requiring City to repair stoplight(s). TRO is usually to order D to desist. not take affirmative action - plus. it is kind of late! Preliminary & permanent injunction may apply. Restitution: Although City has been unjustly enriched by not expending money on repairs. this is not a benefit conferred by P&P on the City. so no restitution. Defenses: possible government immunity (at least against punitives). although this seems like a mandatory obligation. Laches may bar injunctive relief. . Enforcement of judgment: The court can order a government defendant to pay damages and to make repairs - constructive trust and lien probably will not work against a government tortfeasor. Conclusion: P & P will maximize recovery with a judgment against both the Hospital and the City (which is a deeper pocket than David) - but beware of double recovery against David and the City.
