Chapter 10 – Occupational Health and Safety Strategic Importance of Occupational Health and Safety – The challenge and opportunity is to create and sustain a health and safety culture in the workplace that encourages everyone to exercise personal accountability for health and safety, to continually raise questions about policies and procedures around health and safety, and to offer recommendations that enhance safety and wellness Shared Responsibility Model: a new approach to health and safety in the workplace that communicates the importance of employer and employee cooperation to reduce accident rates. Basic Facts about Occupational Health and Safety – Occupational Health and Safety Legislation: laws intended to protect the health and safety of workers by minimizing work-related accidents and illnesses. Purpose General health and safety rules Rules for specific industries (ex. Mining) Rules related to specific hazards (ex. Asbestos) Responsibilities and rights of employers and employees Due Diligence Requirement: employers are responsible for taking every reasonable precaution to ensure the health and safety of their workers. Duties of the employer Filing government accident reports Maintaining records Posting safety notices and legislative information Rights of employees under joint responsibility model The right to know about what hazards are present on the job, how these hazards affect the employee, and what health and safety training is available The right to participate in the occupational health and safety process The right to refuse unsafe work without fear of reprisals if they have “reasonable cause” (a complaint about a workplace hazard has not been satisfactorily resolved or a safety problem places employees in immediate danger) to believe the work is dangerous Joint health and safety committees Provide a non-adversarial atmosphere where management and labour can work together to ensure a safe and healthy workplace Strong, consistent, and visible leadership and resource support, engage all employees to take an active role in health and safety Continuous regular inspections are required
