Vernon Ong JCA: GROUNDS OF JUDGMENTINTRODUCTION [1] The 1 st and 2 nd appellants were charged for kidnapping under s 3 of the Kidnapping Act 1961 (Act 365) read with s 34 of the Penal Code (PC) . The appellants were convicted and sentenced to imprisonment for life and 10 strokes with whipping of 10 strokes each. This is their appeal. After hearing of counsel, we dismissed the appeal on 13.12.2016. We now proceed to give our reasons. FINDINGS OF THE HIGH COURT [2] At about 10:30pm, on the night of 25.9.2012, Arun Alagusuntharam a/l Venkatchalam (SP11) was travelling back home in a car driven by his father’s driver after tuition classes when SP11 was forcibly abducted by several men and confined in a drain near Taman Golf, Alor Setar, Kedah. [3] Later that night, SP11’s father ( SP3 ) received a telephone call from an unidentified person who demanded for a ransom of RM500,000.00 for the release of his son. Meanwhile, SP3 made a police report on the incident. The following day, after receiving numerous telephone calls asking for the ransom money, SP3 and the kidnappers agreed on the reduced ransom sum of RM350,000.00 to be handed over in Sungai Petani. [4] On 27.9.2012, SP3 managed to compile RM350,000.00 in cash. The notes were counted and their serial numbers recorded by a police officer. As instructed, SP3 brought the ransom money to Central Square Supermarket in Sungai Petani; there he received a telephone call to go to the Stesen Bas Lama Sungai Petani. When he arrived at Stesen Bas Lama Sungai Petani, he was instructed to go to the Stesen Bas Express, Sungai Petani. Whilst there, SP3 waited until about 7:40 pm when the 1 st appellant approached SP3’s car and knocked on the car window. The 1 st appellant then entered SP3’s car. After taking the ransom money, the 1 st appellant exited the car and left on a motorcycle.
