No. 134241August 11, 2003FACTSPetitioner David Reyes as seller and respondent Jose Lim as buyer entered into a contract to sell aparcel of land in Pasay City, while Harrison Lumber occupied the same as lessee with a monthlyrental of PHP 35,000.00.So on March 23, 1995, Reyes filed a complaint for annulment of contract and damages against Limand Harrison Lumber, claiming that Lim connived with Harrison Lumber not to vacate the property inorder to defraud him.Lim, on the other hand, filed his answer stating that he is willing to pay for the purchase price, butReyes kept on postponing meeting him.
