While there are many bodies that perform these duties, two of the most important andrecognized are the Inter-American Court of Human Rights (IACHR) and the European Court ofJustice (ECJ). These courts, operating in different parts of the world and for different purposes,were created in order to help with the ongoing and growing questions regarding the affairs ofinterstate interaction and increased protections for citizens against violations from their nationalgovernments. Their effectiveness, however, depends largely on the compliance of the member-states, reliance the member-states have on the institution as a whole, and ability for the courtsto impose sanctions in situations of noncompliance.The IACHR is apart of the Organization of American States (OAS), a body created inorder to protect and advance the rights of its member-states. There are 35 states that are apartof the OAS with 20 states accepting the Court’s optional jurisdiction (“The Inter-AmericanHuman Rights System”). The two documents required for ratification by its members are theAmerican Convention on Human Rights and the American Declaration of the Rights and Dutiesof Men. The former stands more on the lines of a treaty and is more binding than the latterwhich lacks the same requisite language and obligations (Brewer 778). The Court has bothcontentious and advisory jurisdiction and can only see cases that are referred to it by the Inter-American Commission of Human Rights, another body of the OAS which acts to protect humanrights before the need for judicial intervention, or by the state itself within three months release
