gloves and then handled the leather glove collected as evidence from Tang’s property without first changing his latex gloves, possibly transferring Tang’s reference sample blood to the leather glove (this is confirmed in your copies of the lab reports from the LA County forensic DNA lab). They suggest that some other person (or persons) unknown committed the crime, and Tang is innocent. On the other hand, the prosecution has argued that the DNA evidence is not consistent with this defense theory. Discuss at least two reasons why this defense theory is not supported by DNA evidence. (4 points). One of the reasons why this defense theory is not supported by DNA evidence is because even with the possibly transfer of Tang’s reference sample blood, there were a total of three glove blood samples, two of which have Tang’s blood on them, which rules out the probability that even if some of Tang’s blood did get on the gloves, his blood was already there. Another reason why this defense theory is not supported by DNA evidence is because the drops of blood at the crime scene had to have been there before police collected the blood sample. 8

A211 Name _________________ Case TWO Background: A famous model, whom we will call Billie Jean, made a splash in the news last month when she claimed that a young pop star, whom we will call Mike Johnson, was the father of her son, whom she has named Orange. Although Mike Johnson has confirmed that they knew each other, he claims that he is not the father of her child, saying ‘She’s just a girl that I used to chill with, we had fun at the clubs, but I broke her heart and now she’s trying to get back at me. I’m not the one – the kid is not my son.” In fact, last week Jerry Whiteheart, a photographer who had been romantically linked to Billy Jean last year, came forward to claim the son as his own. But pictures of the boy, obtained exclusively by the news magazine “Entertainment Edition”, have been used to suggest that Orange has Mike Johnson’s eyes. Billie Jean has filed a paternity suit claiming that Mike Johnson is the father, while Jerry Whiteheart has filed for parental visitation rights. All three parties have agreed to settle the issue on the television talk show, “Dr. Charles”, hosted by a celebrity psychiatrist. The show will be aired live tomorrow, and the producers have hired you as a DNA expert to analyze the CODIS marker results they have obtained in their paternity tests, prior to presenting them on the show. You have signed an extensive confidentiality agreement. Billie Jean happens to be African American, as does Jerry Whiteheart, while Mike Johnson is Hispanic. Below are the CODIS results from the samples submitted for the paternity test:   Genotype CODIS  Marker Billie Jean Orange Mike Johnson Jerry Whiteheart CSF1PO 10, 13 13, 14 8, 14 10, 14 FGA 24, 28 20, 24 19.2, 20 21, 24 THO1 7, 9.3 7, 9.3 7, 8 6, 9.3 TPOX 11, 11 6, 11 6, 8 11, 12 VWA 16, 18 13, 18 13, 18 15, 18 D3S1358 15, 18 15, 19 15.2, 19 16, 18 D5S818 9, 11 11, 12 12, 12 7, 10
