Federal civil rights laws and the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule, together protect your fundamental rights of nondiscrimination and health information privacy. Civil Rights help to protect you from unfair treatment or discrimination, because of your race, color, national origin, disability, age, sex (gender), or religion. Federal laws also provide conscience protections for health care providers. The Office of Civil Rights (OCR) Title VI and VII has a legal obligation and duty, to protect you from healthcare discrimination from certain healthcare programs to inform you as a patient of your civil rights as it pertains to your health information records and where to file an formal complaint if you feel as though your healthcare information has been compromised, within 180 days of the violation has occurred.
ConclusionIt is important for health care organizations, physicians and providers to understand the healthcarelaws and regulations which impact the healthcare industry and protect the patients privacy. The medical provider must plan a course of action in regards to patient medical records. They must keep the records in a secure encrypted manner. They must provide the staff with education and full instructions on how to implement and set the stage of retrieval of this information. This is important not only to the organizationbut also for the protection and confidentiality of patient. As healthcare information continues to evolve there must be better monitoring and security put in place to protect the identifiable patient health care information and right to privacy as regulated under federal, state and local statues.References:Health Information Privacy.
