Durkheim’s ideas influenced several major theoretical movements in the twentieth century. For instance, it was strongly present in the emergence of structuralism through the work of Jean Pignet and Clause Levi-Strauss.

The Division of Labor Adam Smith was the first to attempt to elaborate the theory of the division of labor. Social solidarity is a wholly moral phenomenon which by itself is not amenable to exact observation and especially not to measurement. Indeed where social solidarity exists, in spite of its non-material nature, it doesn’t remain in a state of pure potentially, but shows its presence through perceptible effects. The most widespread classification is that which divides law into public and private law . Public law is held regulate the relationships of the individual with state, private law those of individuals with another. Legal rules must be divided in two main species, repressive or restitutory . The former covers all penal law ; the latter civil law,commercial law,procedural law,administrative and constitutional law, when any penal laws which maybe which maybe attached to them have been removed. Mechanical Solidarity, or Solidarity by Similarities The totality of beliefs and sentiments common to average members of a society forms a determinate system with a life of its own. It can be termed the colective or common consciousness. A repressive law system is one in which any law breaker is severly punished for their crimes. This type of law exist in mechanical solidarity because the laws are based on the very powerful collective conscience , or set of social norms, that the people in a mechanical society all strongly believe in.
