In the beginning ofthis legislation, administrators were required to establish and apply a totally new set of laws unfamiliar to them that were drastic changes to how healthcare was practiced. According to L. Staudter, she spent months creating and implementing policies for the entire Good Samaritan system which includes hospitals and private practices to rapidly adjust to the new law (2020). Many providers were simply not ready for this thus creating a massive unintended consequence of the passing of HIPAA in 1996. RecommendationsEfficacyHIPAA has, and continues to, address population needs without substantial negative consequences on the target population or other populations. HIPAA was created in order to set national standards to prevent patient health information from being disclosed without consent or knowledge of the patient (CDC, 2018). The policy has managed to accomplish this by making sure that PHI stays protected while also permitting the flow of information that is necessary to provide quality care and by protecting any individually identifiable information that a covered entity records, receives, and sends electronically (2018). Another measure of success is making patients more involved in their own healthcare. HIPAA promotes this through by creating the opportunity for people to be able to be a contributor in their own medical files. Prior to HIPAA, there was a lack of access to personal medical files but now the ability to amend PHI has made it easier to change jobs without worrying about the status of their health insurance (LG). During its inception, the main goal was to make sure health coverage followed those who sought out a new occupation (HIPAA Journal, 2015). It makes patients feel safe and secure knowing that there are safeguards at various levels of security in place to prevent the misuse of their PHI. Areas of ImprovementThere are some regulatory gaps in HIPAA that need to be addressed in order to adapt to the modern era. When HIPAA was established the health technology was not as advanced as it is today. The intent of the legislation was portability, privacy, and accountability. Security needs to be further addressed due to the current landscape of technology. The primary issue with HIPAA is that when it was written it was meant to hold providers accountable over the patient data in their charge (Davis, 2019).
