COURSEWORK 3 The change of the rules from DPA to GDPR have also strengthen the conditions for consent, therefore PhysioBest has to comply. It is important to update the staffs of PhysioBest that under GDPR they will no longer use long illegible terms and conditions, because the consent must be provided in an understandable way and easily accessible form, which a clear reason as to why they are processing the data included in the consent form. Moreover, under GDPR, the staffs of PhysioBest will have to use a clear and a plain language in the consent. The change of the data processing policy under GDPR advocates for data transparency and empowerment of the data subjects. As such, the PhysioBest’s clients will have rights for the data subjects. The staffs in charge of the data controller information will have to inform their clients whether their personal data is being processed, where they are being processed and the purpose of the process. Moreover, the controller will have to provide their clients with a free copy of their personal data, in electronic form. Under GDPR, breach notification is given prominence. Staffs at PhysioBest need to be aware that breach notification is made compulsory to all members states of EU especially where the breach of data is likely to compromise the rights and freedoms of individuals. GDPR policy requires that notification be made within 72 hours after the beach has been noted (Wachter, Mittelstadt, and Floridi, 2017). Data processors working at PhysioBest will also be expected to notify their clients about the breach without undue delay after they have become aware of the breach. The current DPA policy outlines that an individual data shall be gathers for a particular purpose, and the data shall not be used in any other purpose incompatible with the original purpose. According, under this principle, PhysioBest will ensure that the obtained data is only used for the original intended purpose only. There is not much change that GDPR has brought in light to this principle, however, the change policy emphasizes on the right to be forgotten. This is also known as Data Eraser. COURSEWORK 4 avoid further processing of the data, also prevent a third party from accessing the data. The condition for eraser is well spelled in article 17, which posits that the data need to be erased when it is no longer relevant of the original purpose of processing. The staffs of PhysioBest should take note of this that they should only use the data for the intended purpose thereafter it should be erased to avoid being used for the purposes that it was not intended for or avoid reaching a third party. Currently, data controllers are expected to inform the local DPAs about their data processing activities. GDPR liberations found this practice to be bureaucratic for the multinationals.
