Are you Sirius? In a major victory for Sirius XM in long-running copyright litigation, New York’s highest appeals court held that New York law does not provide a “performance right” in pre-1972 recordings, meaning that Sirius XM and other broadcasters are not required to obtain permission from or pay compensation to owners of pre-1972 recordings to play their records. This ruling represented a complete reversal of the decision reached by the federal court in New York, and was the first appellate decision anywhere in the country to resolve this issue. October 2016 Outdoorsy O’Melveny O’Melveny serves as antitrust counsel to outdoor gear and apparel retailer Bass Pro Shops in its US$5.5 billion acquisi- tion of camping and hunting retailer Cabela’s, announced in late 2016. The private equity-backed deal would combine two of the largest sporting brands in the US. April 2016 Like a Virgin O’Melveny advised Alaska Airlines in its $4 billion acquisition of Virgin America. The acquisition expands the Alaska Airlines’ route network with nearly 1,200 daily flights to 118 destina- tions across the United States, Mexico, Canada, Costa Rica, and Cuba, making it the fifth-largest US airline. GETTING HIRED Vault’s Verdict: O’Melveny wants bright students from good law schools, but their hiring process is meant to be holistic, and the firm is unafraid to hire from a wide swath of schools. Hiring Process • “My firm makes a really strong effort to make sure that all hires are uniquely kind people who fit into the culture of our firm and office. The firm does not place and overly strong emphasis on school which I admire and I think has led to the hiring of some particularly outstanding associates.” • “The firm takes a holistic approach to hiring. The initial cut is based on grades, journal experience, and prior work experience, but the interview process focuses on whether a person would be a good fit with the firm’s culture. When I was being recruited, I felt like I was being considered as a whole person, including my attitude, sense of humor, and values, and not based on numbers or because I would fit in a particular box. As someone who is now actively involved in recruiting, I approach candidates the same way. We regularly pass on candidates who look great on paper but do not seem like they would work out as people based on their interpersonal skills, including their level of maturity and professionalism.” • “We are looking for top law students from top 20 schools (mostly T-14) who are interested in doing cutting edge litigation and transactional work. Excellent writing skills are a must. We work hard and expect exceptional work product.” • “Although O’Melveny is a strong believer in ‘one firm’ governance, the hiring process can definitely differ significantly by office.
