Do you think that a higher standard of confidentiality is due health care workers? There is already a policy regarding the confidentiality of patient’s information. According to an online article, the fundamental right to privacy is guaranteed by the 5 th and 14 th Amendments of the U.S. Constitution (enotes, 2013). “ As early as in Roe v. Wade, 410 U. S. 113 (1973), the U. S. Supreme Court acknowledged that the doctor-patient relationship is one which evokes constitutional rights of privacy. But even that right is not absolute and must be weighed against the state or federal interest at stake” (enotes, 2013). The article also mentioned that this is actually a privilege that belongs that the patient, because if the patient sends a consent to the doctor that he/she can divulge the information, the doctor can do so. Thus, only a patient can waive the privilege.

Basically, the Congress passed this law to ensure protection for medical records and personal information of patients.
