spent money on the war without Congressional appropriation, suspended the writ of habeas corpus, and then justified his actions in a meeting of Congress 3 months later. These actions are illegal because not only do they violate some articles and sections of the Constitution, but his actions violated actions that were confined to another branch of the government completely. 4. Lincoln justified the Emancipation Proclamation through the Constitution, calling it a “military necessity”, and states that as the commander-in-chief, “[he] has the right to take any measure which may best subdue the enemy”. 5. FDR justified the destroyer for bases deal and the North Atlantic war by claiming that the legislation and deals brought profits to the US while keeping the US equivocally out of the war. However, he did not claim his position as commander-in-chief as justification for the deal. 6. In my personal opinion, FDR and Lincoln clearly exceeded their authority, but in their particular cases, were justified in doing so. They faced times of disparity and danger that threatened the livelihood of the nation, and it was a mere coincidence that this abuse of power was undertaken by two of the best presidents this nation has seen. I think in respect to those two, they took steps they thought best protected their country and states, but if any other president had been in their position, it would not turn out nearly the same.
