11/4/19 10 Enforcement in State of Nature Each has a common right to punish wrongdoers on behalf of all, and a particular right to pursue recompense of harm to oneself Objection “But no one is a fair judge of their own cause” (self-serving bias) Locke says, Correct, but That’s a good reason to enter civil society together And what is an absolute monarch but one who unfairly judges their own cause? 37 Locke’s State of Nature is not like Hobbes’ Locke’s State of Nature can be in a state of peace or a state of war Locke: I have a right to preserve myself from destruction For example in state of nature or in civil society , A thief that tries to control me I have the right to kill But, in civil society any further dispute is settled by law Locke: in state of nature , violence done in a situation like that is likely to escalate into a state of war That’s a good reason for us to join together in civil society and live under law 38 Liberty in Civil Society Locke: Liberty in state of nature -- do not harm self or others, and you are not under any other person’s authority Locke: Liberty in civil society One is only subject to a legislative power established by consent Our liberty is entrusted to that limited sovereign If the sovereign betrays that trust by arbitrary abuse of power, then we may remove our consent, we have the right to rebel No one can rightfully agree to a contract of slavery , because one is made by God and cannot agree to one’s own destruction Note: “appeal to heaven” means violent rebellion Start a revolution and God will choose the winner!
