Keller’s claims said that when he was terminated, West Coast breached an “implied” employee contract that he could only be terminated for a “good cause.” In court papers, West Coast said, that Keller’s case was mostly based on “a mere convenient coincidence.” Keller felt otherwise and went ahead with the lawsuit. He was adamant that he had not been terminated due to the economy or his performance but for comments heard while West Coast was eavesdropping on him. A “pocket dial” occurred a few days before his termination from Mr. Keller’s phone to the other sales manager, Mr. Miller. Keller was on a rant and Miller decided to get the chief operating officer, he then called on an assistant to take notes of the conversation. Keller feels that this is why he was terminated and his privacy was invaded. He decided to sue for more than $1.2 million, for compensation for lost earnings, statutory violations regarding the eavesdropping counts, and an unspecified amount in punitive damages.
