privatize the land, which would no longer make it qualify under the term “public use.” The case advanced to the Supreme Court which ruled 5-4 in favor of the city of New London. The court said that although the taking does not directly benefit the community it will bring economic benefit by bringing jobs and people to the area (Cohen). This Supreme Court case defined the meaning of “public use” in the takings clause. Previously, eminent domain was strictly used for obvious public use such as the buildings of roads and bridges, however, after Kelo v New London eminent domain started being used to economically benefit communities, which allows them to grow (Somin).
Ostrowski 3 Eminent domain brings economic growth to local communities. After Kelo v City of New London the government was able to acquire property and give the land to private companies to bring economic growth to communities. For example, if there is a piece of land that serves no purpose for the community and the government wants to refurbish the area, the government should be able to use eminent domain to give land to a business. This will improve the community because it will attract more people to the area, which will benefit local businesses, and provide more residents to tax, thus creating more money for the economy. A major use of eminent domain was the building of interstate 80. Interstate 80 is a highway that connects New York City to San Francisco; the highway runs through many rural parts of the country. Thousands of people travel on this highway each day. This attracts thousands of people to rural areas in the United States. If a person is driving a long distance on this highway, they will eventually need gas, food, or a hotel. They would then take an exit into an area they would have never gone to if the highway did not exist. This benefits communities because it allows businesses, such as hotels and restaurants, to open in the area. Businesses then can be taxed which brings in more money for local government and allows more jobs for local people. With almost every major highway, eminent domain was used and benefits communities. Florida Gulf Coast University mapped the areas of the country where eminent domain was used. Then, they mapped the areas that had the most economic growth (Hathaway). There was a strong correlation between the use of eminent domain and economic growth proving that eminent domain leads to economic growth of local communities. Prior to the 2005 supreme court case Kelo v New London, most eminent domain cases directly benefit communities by public use which allows parks, schools, hospitals and roads to be built. For example, if the nearest school or hospital was 45 minutes away, which is the case for
Ostrowski 4 many people in the rural United States, eminent domain could seize property and build a school or a hospital benefiting people in this area. If communities have schools and hospitals near them the people of the community will be happier with the community. A Duke University study
