The defense has suggested that Tang is the victim of a frame-up, and that much of this evidence was planted both at the scene of the crime and at Tang’s estate and in his SUV. They note that the police officer who collected Tang’s reference blood sample kept that blood sample in his possession for more than eight hours before logging it in as evidence, and lab records appear to indicate that about 1.5 milliliters of this blood sample are unaccounted for (this is confirmed in your copies of the lab reports from the LA County forensic DNA lab). They have a theory that the police planted Tang’s blood at the crime scene. They also note that one of the DNA lab technicians admitted that he got blood from Tang’s reference sample on his latex gloves and then handled the leather glove collected as evidence from Tang’s property without first changing his latex gloves, possibly transferring Tang’s reference sample blood to the leather glove (this is confirmed in your copies of the lab reports from the LA County forensic DNA lab). They suggest that some other person (or persons) unknown committed the crime, and Tang is innocent. On the other hand, the prosecution has argued that the DNA evidence is not consistent with this defense theory. Discuss at least two reasons why this defense theory is not supported by DNA evidence. (4 points). One of the reasons why this defense theory is not supported by DNA evidence is because even with the possibly transfer of Tang’s reference sample blood, there were a total of three glove blood samples, two of which have Tang’s blood on them, which rules out the probability that even if some of Tang’s blood did get on the gloves, his blood was already there. Another reason why this defense theory is not supported by DNA evidence is because the drops of blood at the crime scene had to have been there before police collected the blood sample. 8
