Intermediate courts [2.8] Intermediate courts are the middle rung in the hierarchy ... Jurisdiction [2.9] The intermediate courts have an original jurisdiction to hear important civil matters, involving disputes and claims for substantial amounts of money. The civil jurisdiction of this level court varies between states and is set out in the legislation of each state. A jury may be used in some civil matters, such as defamation. Intermediate courts have a criminal jurisdiction over serious criminal offences, with a jury appointed when a criminal matter is heard for the first time. There is a limit to the criminal jurisdiction of the court with serious crimes such as murder removed from this court's authority. The intermediate courts have an appellate jurisdiction. A judge sitting alone may hear an appeal from a decision of a Magistrate's Court. Superior courts [2.10] The Supreme Court is at the top of each State court hierarchy. This court hears very serious matters, such as crimes of murder. The Supreme Court also hears civil matters where the monetary amount exceeds the jurisdiction of the intermediate level court in its system. A jury is used for criminal matters beard for the first time, and for some civil claims. There is no limit to the jurisdiction of this court except for matters, which fall within the jurisdiction of the federal courts or the High Court Appeals [2.11] A Supreme Court has an appellate jurisdiction and hears appeals from the two lower courts before a single judge. The appeal will take place before either three judges or the full bench of five judges. The Supreme Court is very formal with strict procedures being followed in the preparation and presentation of material to the court. The decisions are often reported in law reports and of course they determine the law that must be followed by lower courts. Supreme Court Justices are appointed from the legal profession; often they are leading barristers, or judges of the intermediate courts. The High Court [2.12] The High Court is the pre-eminent Australian court. It was established under the Constitution and has a wide original jurisdiction. It is especially important because it has the jurisdiction to determine disputes between States, or between the States and the Commonwealth. Under the Constitution there is an appellate jurisdiction which results in the High Court being the final appeals court from all courts - State, Territory and federal. Not all cases are able to go on appeal to the High Court and it is necessary to seek leave to appeal.
