In a study of one urban school district 3,587 African American males missed 3714 school days in a year due to suspensions (Bonner, Joubert, 2010). When students are out of school they miss valuable instructional time. These students lack the knowledge needed to past state mandated test. As a result, these students will fall farther behind every day that they miss out on instruction. Schools need to invest in positive ways to keep these students in the classroom.

This resulted in the criminalization of minor infractions. Rather than schools dealing with the problems they are referring these students to the court system. Students of color are being referred to the juvenile justice system at an alarming rate. Schools are pushing students into the system when they exclude them from the learning environment (Butler, 2012). Policies make it more likely that students face criminal charges than get a good education (Malett, 2010). According to experts increasing pressure from advocacy groups critical of the large numbers of suspensions and expulsions of African- American boys has forced school districts to rethink the Zero Tolerance Policy. Obama and the Justice Department have come together to reform Zero tolerance policies (Department of Education, 2014). Department of Education outlines recommendations for school officials in implementing disciplinary policies. The guidelines also focuses on schools creating a more inviting environments for students. The recommendation included prevention based strategies and training for school officials (2014). School authorities have a responsibility to develop a caring, nurturing learning environment for all students (Texas Educator Code 2004). When discipline is applied fairly and appropriately, it will influence student’s character and make them have a feeling of community (Feldman, 2000). School district should consider factors that will allow administration to give fair judgement on a case by case basis (20000. Administration should only be using zero tolerance policy for major crimes that warrant Police being called.
