Can educate people why the porn is bad, rather than censor 1. A community’s measures to do this may be questionable, but less dangerous than government censorship 10. A few other questions from Wicclair: 1. If the acts depicted in porn are not illegal, why should the production of the porn be illegal 2. Laws can be ambiguous and subjective – need clear criteria to prevent too much discretionary power 3. Difficult to determine the “point of view” of the film, book, pic, etc. 4. How can we censor only certain sexual activities? No causal evidence of connection between harm to women and porn so should we censor all material with objectionable images of women? Should we censor all sexual material? Too narrow or too broad 5.Why just women? Should we censor material that portrays anyone in a degrading light? 1. Censorship would be the rule, not the exception 2.Should women get special protection? If yes, reinforcing that women are “naturally” more fragile and vulnerable than men (basically hypocritical) 1. Women have been treated as inferior sex through out history Skokie vs. National Socialist Party (’78); IL Supreme Court Background 1. In Skokie, IL, predominantly Jewish, many concentration camp survivors 1. Jews thought purpose of demonstration in heart to Jewish community was to remind survivors the Nazis weren’t through with them and that the Nazi threat was not over 2. Were to have a counter demonstration, would most likely end in violence 2. Nazi Part wanted to have a peaceful demonstration in Skokie Park, would march back and forth in uniforms including swastika armband, carrying the party banner, with swastika, and holding signs with white supremacist type statements; wouldn’t distribute pamphlets or make derogatory statements towards any religious or ethnic groups, or obstruct traffic, would cooperate with police Preliminary Court Decisions 1. Circuit court said can't:

1. 1.) March in Nazi uniform 2. 2.) Display swastika on or off person 3. 3.) Distribute pamphlets or display materials about hatred for Jewish faith or any other faith 2. Appellate court said can march, wear the uniform, and distribute info, but can't display the swastika 1. Appealed again IL Supreme Court Decision 1. Had to decide if displaying the swastika was in violation of the first amendments 2. Looked at previous court cases: 1. Cohen vs. CA (’71): 1.Permitted the demonstration of the swastika because public expression (including clothing) can't be prohibited just because it is offensive to the hearers, it is symbolic expression of thought which is protected by the 1stamendment 2. Cohen wore the “fuck the draft” shirt in LA court house 3. Case re-stated the “fighting words doctrine” from the Chaplinsky case, Skokie’s swastika doesn’t fall within the definition of fighting words 4. Nor is swastika so offensive it threatens the peace 5. Ideas thrust upon unwilling listeners doesn’t mean should be prohibited (outside privacy of home) 2. **Rockwell vs. Morris (’61) 1. Nazi leader wanting to demonstrate in Central Park 2.
