which the employer has the right to expect of his employee, or in carelessness or negligence of such degree or recurrence as to manifest equal culpability, wrongful intent or evil design or to show an intentional and substantial disregard of the employer’s interests or of the employee’s duties and obligations to his employer. On the other hand, mere inefficiency, unsatisfactory conduct, failure in good performance as the result of inability or incapacity, inadvertencies or ordinary negligence in isolated instances, or good faith errors in judgment or discretion are not to be deemed ‘misconduct’ within the meaning of the statute.

PA205 Unit 6 Assignment 4. Facts May 2009 , Natalie Attired, age 23, began working as a waitress at Biddy’s Tea House and Croissanterie in Truth or Consequences, NM. Biddy’s Tea House, in business for over 20 years. Run by Biddy Baker, age 60. There is no employee manual or written policy about employee conduct. June 2010, Natalie purchased a tattoo which covered her entire upper right arm, from shoulder to elbow (photo attached). The tattoo was partially covered by the waitress uniform, but the lower portion near the elbow could be seen when the short-sleeved uniform was worn. Biddy Baker was upset at this change in Natalie’s appearance and told Natalie that if the tattoo was not removed she would be fired.
