A spatial pattern emerged and it is hypothesized that First Nations near urban areas are more likely to adopt the FA than First Nations in remote areas due to two reasons: the ability to develop land codes that take advantage of economic opportunity and the potential for land investment opportunities is greater for First Nations near urban centres. While 77 First Na- tions have become signatory to the FA, only 39 have operational independent land codes (1). It is mentioned within the article that the adoption of FA may produce asymmetrical ben- efits for First Nations’ populations–specifically benefitting leaders of the bands (14). While the adoption of the FA appears to present greater land autonomy for First Nations, I wonder if it fur- ther consolidates settler-colonialism and the state’s legal violence. Inherent to the arbitration of land sovereignty is that it operates through Canadian law–including colonial understandings of property, ownership and land use–and it is the Canadian state that determines the level of land sovereignty granted to First Nations. Therefore, is the FA another tool of colonial assimilation or is it a constructive step towards land autonomy over First Nations’ reserve lands?
