The difference between positivism and classical/neoclassical theory is that people are active agent with free will in a classical school. Unlike the Classical School, Positivism includes causes of crime suggests that people are passive and controlled. Positivism had many weaknesses that it advanced criminological theory by replacing by incompetence of age or insanity. The ideas of the classical school were rejected in the Positivism School. Positivist School contributed to the concept of justice indeterminate sentencing that explains the punishment should fit the criminal instead of the crime. The philosophy of rehabilitation was also included in the positivist. The classical theory think punishment should not be used for rehabilitation, but instead the punishment should be the magnitude of the crime. For Positivist, human beings had no responsibility for their crime.
